Terms of Service

1. INTRODUCTION AND ACCEPTANCE

1.1. The Agreement These Terms of Service ("Terms") constitute a legally binding contract between you ("User," "You") and Algolab Limited ("Company," "We," "Us," "Our"), the owner and operator of the Kimodo App.

1.2. Electronic Acceptance & Signature By accessing, downloading, installing, or using the Kimodo App (the "Service"), or by clicking buttons such as "I Agree," "Sign Up," or "Generate," you expressly acknowledge that you have read, understood, and agreed to be bound by these Terms. This action constitutes a secure electronic signature and a valid acceptance of an electronic contract under Section 21 of the Electronic Transactions Act (Cap 442) of Tanzania.

1.3. Eligibility You represent and warrant that you are at least eighteen (18) years of age and possess the legal capacity to enter into this Agreement under the Law of Contract Act.

2. NATURE OF AI SERVICES AND ACCURACY DISCLAIMER

2.1. Probabilistic Nature of AI You acknowledge and agree that the Kimodo App utilizes Artificial Intelligence (AI) and machine learning technologies. These systems are probabilistic in nature; they generate responses based on patterns in data rather than a database of fixed facts.

2.2. No Warranty of Accuracy (AI Hallucinations) Algolab Limited does not represent or warrant that the content, text, code, images, or other data generated by the Service ("Output") will be accurate, complete, true, reliable, or error-free. You acknowledge that the AI may:

• Generate incorrect, plausible-sounding but false, or misleading information ("hallucinations").
• Produce offensive, biased, or inappropriate content unintended by the Company.
• Omit critical safety warnings or context.

2.3. Human Review Required You agree that you are solely responsible for reviewing, verifying, and fact-checking any Output generated by the App before using, publishing, or relying upon it. You must not rely on the Service as a sole source of truth.

2.4. Not Professional Advice The Output generated by Kimodo App is for informational or creative purposes only. It does not constitute medical, legal, financial, or professional advice. You should consult with a qualified professional in Tanzania before making any decisions based on the App’s Output.

3. INTELLECTUAL PROPERTY RIGHTS

3.1. Ownership of the App All rights, title, and interest in and to the Kimodo App, including its source code, algorithms, interface, trademarks, and "Algolab Limited" branding, remain the exclusive property of Algolab Limited.

3.2. User Input and Output

• Input: You retain ownership of any data, text, or files you upload ("Input").
• Output: To the extent permitted by the Copyright and Neighbouring Rights Act, Algolab Limited hereby assigns to you all rights, title, and interest in the specific content generated by the Service based on your Input ("Output"). However, due to the automated nature of generation, the Company does not guarantee that Output will be unique or protectable under Tanzanian copyright law (which requires human authorship).

4. USER OBLIGATIONS AND PROHIBITED CONTENT

4.1. Compliance with Law You agree to use the Service in strict compliance with the Cybercrimes Act, 2015 and the Electronic and Postal Communications (Online Content) Regulations, 2020 (as amended in 2025).

4.2. Prohibited Uses You shall not use the Kimodo App to generate, upload, or disseminate content that:

• Is indecent, obscene, pornographic, or offensive to public morals.
• Constitutes hate speech, incites violence, or promotes discrimination based on race, religion, tribe, gender, or disability.
• Threatens national security or public order.
• Contains false, deceptive, or misleading information intended to defame, threaten, or abuse others.

4.3. AI and Synthetic Media (Deepfakes) In strict compliance with the 2025 Amendments to the Online Content Regulations, you are expressly prohibited from using the Kimodo App to create or distribute "unethical, fabricated, and artificial intelligence-generated content" (deepfakes) that impersonates individuals, fabricates events, or is likely to mislead the public.

5. CONTENT MODERATION AND TAKEDOWN

5.1. Mandatory Takedown (The 2-Hour Rule) You acknowledge that under Tanzanian regulations, the Company is obligated to remove prohibited content within two (2) hours of receiving a notification from the Tanzania Communications Regulatory Authority (TCRA) or an affected party.

5.2. Suspension We reserve the right to suspend or terminate your account immediately without prior notice to comply with such regulatory orders or if you violate Section 4 of these Terms.

6. DATA PROTECTION

6.1. Privacy Policy Our collection and use of your personal data are governed by our Privacy Policy. We process data in compliance with the Personal Data Protection Act (PDPA), 2022.

6.2. AI Training You acknowledge that, unless you opt-out via your account settings, anonymized Inputs may be used to improve the performance and accuracy of our AI models.

7. LIMITATION OF LIABILITY

7.1. Exclusion of Damages To the fullest extent permitted by the Law of Contract Act, Algolab Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or goodwill;
• Loss of data;
• Damages resulting from your reliance on accurate or inaccurate AI Output.

7.2. Liability Cap In no event shall Algolab Limited's aggregate liability for all claims relating to the Service exceed the total amount paid by you to Algolab Limited for the use of the Service in the twelve (12) months preceding the claim.

8. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Algolab Limited, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:

• Your violation of these Terms;
• Your misuse of the Service;
• Your reliance on AI hallucinations;
• Your violation of any third-party rights (including Intellectual Property).

9. DISPUTE RESOLUTION (ARBITRATION)

9.1. Amicable Settlement Parties shall attempt to resolve any dispute amicably within thirty (30) days.

9.2. Arbitration Clause Any dispute, controversy, or claim arising out of, relating to, or in connection with this contract, including any question regarding its existence, validity, or termination, shall be resolved by arbitration in accordance with the TANZANIA INTERNATIONAL ARBITRATION CENTRE (TIAC) Arbitration Rules.

• Seat of Arbitration: Dar es Salaam, Tanzania.
• Language: English.
• Number of Arbitrators: One (1).

10. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the United Republic of Tanzania.
